1. About these terms
These Terms and Conditions (the Terms) are a legal agreement between you and Growth Garage LLC (Growth Garage, we, us, our), a limited liability company organized under the laws of the State of New Mexico, United States. They govern your use of Blackjack Guru (published on the App Store and Google Play under the Blackjack Guru name), the web version of the app, and the website at www.blackjackguru.com, together the Service.
By downloading, installing, opening, or using the Service, you agree to these Terms. If you do not agree, do not use the Service. For Blackjack Guru, these Terms replace the general Apps Terms of Use previously published at growthgarage.studio.
How we handle information is described in our Privacy Policy, which forms part of these Terms.
2. You must be 18 or over
By using the Service you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. Where the law where you live sets a higher minimum age for simulated gambling content, that higher age applies to you, and you are responsible for making sure your use of the Service is lawful where you are.
The Service is not available in every country, and features can differ by country and platform. We may restrict or withdraw the Play section, chip purchases, or the Service in a jurisdiction where the law makes that appropriate.
3. Entertainment only. Not real money gambling
Blackjack Guru is an educational blackjack trainer combined with a simulated blackjack game, intended for an adult audience for amusement purposes only. You never stake real money on a hand: only virtual chips are used at the table, and you cannot lose money by playing. Money is only ever spent when you choose to make an in-app purchase, and that purchase buys virtual chips or a subscription, not a stake. There are no cash prizes, sweepstakes, tournaments with real prizes, cash outs, or redemptions of any kind.
Practice or success at social gaming does not imply future success at real money gambling. Real money gambling carries financial risk under conditions this app does not reproduce. Our Responsible Use page explains this further.
4. Virtual chips
Chips are the virtual in-app currency of Blackjack Guru. XP, levels, and unlocks are virtual items, and everything in this section applies to them too. Virtual items have no monetary value: they are not money, not a deposit, not a credit balance, and not a store of value, and they are not your property. When you obtain them, by playing, receiving them free, or buying them, you receive a limited, personal, non-transferable, revocable licence to use them inside Blackjack Guru, and nothing more.
Virtual items cannot be cashed out or paid to you in money; redeemed or exchanged for money, goods, services, vouchers, cryptocurrency, or anything else of real world value; sold, traded, gifted, transferred, or assigned to anyone; used as a stake in any real money game; or used anywhere outside Blackjack Guru. Any attempt to do any of these is void and is a breach of these Terms.
Chips you purchase through the App Store or Google Play do not expire. They are not subject to any time limit, reset, or balance decay, and we will not remove them because time has passed. Free and promotional chips are spent before chips you have bought. We may change the chip economy going forward, but we will not reduce or remove chips you have already bought.
Because Blackjack Guru works without an account (see section 7), your balance is held against an anonymous identifier associated with your device. Deleting and reinstalling the app on the same device normally keeps your balance. If you reset your device or move to a different device, the identifier changes and the old balance cannot be recovered, because we have no way to tell that a new installation belongs to you. Please take this into account before buying chips. It is a limitation of an account free design, not an expiry of your chips.
If your access to the Service ends under section 12, or the Service is discontinued, your licence to use virtual items ends with it, and unused virtual items cannot be redeemed for anything of value. This does not affect any refund right you have with Apple or Google, or any statutory right that cannot be excluded.
5. Purchases, subscriptions, and billing
Blackjack Guru is free to download, and every paid element is optional. An optional subscription unlocks unlimited training and the full card counting course. Chip packs are one time purchases that add a fixed, known number of chips to your balance: there is no randomised element and no loot box.
Purchases inside the mobile app are processed through Apple In-App Purchase or Google Play Billing, and Apple or Google is the merchant of record. We never see or store your payment card details. Prices are shown in your local currency before you confirm.
Recurring subscriptions renew automatically at the end of each period unless you cancel before it ends, and Apple charges renewals within the 24 hours before the period ends, so cancel at least a day early to be safe. Free trials convert into a paid subscription unless cancelled before the trial ends. You manage or cancel subscriptions in your App Store or Google Play account settings, not through us: step by step instructions are on our cancellation page.
6. Refunds
To request a refund, use reportaproblem.apple.com for Apple, or play.google.com/store/account/orderhistory for Google Play. If you are a consumer in the European Economic Area or the United Kingdom, you have a statutory 14 day withdrawal right for digital content, subject to how the platform purchase flow handles immediate delivery. Nothing in these Terms limits any statutory right that cannot be limited.
If a chip purchase is refunded or charged back after the chips were delivered, we may remove an equivalent number of chips, and repeated refund abuse may lead us to restrict purchases or access. Chips that have been played at the table create no claim and are not refundable by us, because they never had monetary value. Cancelling a subscription stops future renewals; you keep access until the end of the period you paid for.
7. No account, your progress, and your device
Blackjack Guru does not require an account: no sign up, no username, no password, no email address. Your progress, including training statistics, chip balance, XP, level, and unlocks, is stored on your device and synced to our cloud storage against an anonymous identifier associated with your device. It is not linked to your name or any account.
You can delete the data held against your installation at any time: see section 10 of the Privacy Policy.
8. Advertising in the app
Blackjack Guru shows third party advertising, delivered through AppLovin MAX and the networks it mediates. We block real money casino, sportsbook, betting, lottery, and gambling affiliate advertising on every network that serves ads in the app, and we do not link to or promote any real money gambling operator anywhere in the Service. If an ad like that reaches you anyway, report it with the ad’s report control or write to info@blackjacktrainingapp.com and we will block the advertiser.
The information advertising uses, and your choices over personalised advertising, are explained in the Privacy Policy.
9. Things you agree not to do
You agree that you will not:
- Use the Service if you are under 18, or help anyone under 18 to use it;
- Buy, sell, trade, gift, or transfer chips, virtual items, installations, or device profiles, or use any third party service that offers to;
- Use the Service for real money gambling, or represent that it offers real money gambling or a chance to win money or prizes;
- Cheat, or use bots, automation, modified clients, or similar tools to alter play, the chip economy, or entitlements, or exploit a bug for gain instead of reporting it;
- Reverse engineer or decompile the Service except where law expressly permits it, or circumvent security, purchase verification, or usage limits;
- Copy, scrape, or redistribute the strategy tables, the card counting course, or other content of the Service;
- Use the Service unlawfully, or interfere with its operation or with anyone else’s use of it.
10. Licence and intellectual property
We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app on a device you own or control, and to use the website, for personal, non-commercial purposes, in accordance with these Terms and the rules of the store you installed from.
Everything in the Service, including the software, design, strategy tables, card counting course, artwork, and the Blackjack Guru name and logo, is owned by Growth Garage or its licensors and protected by law. These Terms transfer none of it to you. If you send us feedback, we may use it without obligation or payment.
11. The training content
The strategy tables, drills, and card counting course are provided for education and entertainment. Correct basic strategy reduces the house edge but does not remove it and guarantees no particular result: variance is large, and no sequence of good decisions guarantees a good outcome, in this app or anywhere else.
We make no representation that the material can, should, or lawfully may be used in a real casino. Casinos set their own rules and may refuse service, and gambling laws differ by jurisdiction. Anything you do outside the Service is your responsibility alone.
12. Changes, suspension, and termination
We may add, change, or remove features and content, and may test features with a subset of users. Where a change would materially reduce a paid feature you have bought, we will give notice where practical, and your refund and statutory rights are unaffected.
You can stop using the Service at any time. We may suspend or end your access, with notice where reasonably practical, if you breach these Terms (in particular sections 4 and 9), if we reasonably suspect fraud or refund abuse, if we are required to by law or by Apple or Google, or if we discontinue the Service. The consequences for virtual items are in section 4. Sections 4, 6, 10, 13, and 15 survive termination.
13. Disclaimers, liability, and indemnity
To the fullest extent permitted by law, the Service is provided as is and as available, without warranties of any kind, express, implied, or statutory, and we do not warrant that it will be uninterrupted, error free, or compatible with every device.
To the fullest extent permitted by law, Growth Garage is not liable for indirect, incidental, consequential, or punitive damages, or loss of profits, goodwill, or data, and our total aggregate liability in connection with the Service is limited to the greater of the amount you paid for the Service in the twelve months before the claim arose, or fifty United States dollars. A change in your chip balance and a lost simulated hand are not financial losses, because virtual items have no monetary value and nothing of value is staked.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded, including mandatory consumer rights where you live. You agree to indemnify Growth Garage against claims and reasonable costs arising from your breach of these Terms or your violation of law, to the extent the claim results from something you did.
14. Apple and Google
These Terms are between you and Growth Garage only, not with Apple Inc. or Google LLC, and Growth Garage, not Apple or Google, is solely responsible for Blackjack Guru. For the version downloaded from the Apple App Store:
- The licence in section 10 is limited to use on Apple branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price, if any; Apple has no other warranty obligation.
- Growth Garage, not Apple, is responsible for any claim relating to the app, including product liability, regulatory, consumer protection, and intellectual property claims.
- You represent that you are not located in a country subject to a United States Government embargo or designated as terrorist supporting, and are not on any United States Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you.
15. Governing law and disputes
These Terms and any dispute arising out of them or the Service are governed by the laws of the State of New Mexico, United States, without regard to its conflict of law rules, and the state and federal courts located in New Mexico have jurisdiction, subject to the paragraph below.
If something has gone wrong, please write to info@blackjacktrainingapp.com before starting formal proceedings. We will try in good faith to resolve it with you within 30 days.
16. General
These Terms and the Privacy Policy are the whole agreement between you and us about the Service. If any part is unenforceable, the rest continues to apply. Not enforcing a right straight away is not a waiver of it. You may not transfer your rights under these Terms; we may transfer ours to an affiliate or in connection with a merger or sale, provided your rights are not reduced. We are not liable for failure to perform caused by events outside our reasonable control. These Terms are written in English, and the English version applies if a translation conflicts. We may give notice in the app or on this website.
17. Changes to these Terms
We may update these Terms, and the effective date at the top shows the current version. If a change is material we will give reasonable notice before it takes effect, in the app or on this website. Continuing to use the Service after a change takes effect means you accept the updated Terms. We keep dated copies of previous versions: write to us if you would like one.
